Agreement to legal terms

We are WEBEKSPRES ("the Company", "we"), operating as PT Webekspres Teknologi Indonesia. We manage the site https://webekspres.id/ along with related products and services referred to in these terms (collectively, the "Services").

These terms form a binding agreement between you (whether personally or on behalf of an entity) and WEBEKSPRES regarding access to and use of the Services. If you do not agree with all of these terms, you are prohibited from using the Services and must stop using them immediately.

We reserve the right to change these terms at any time. Changes are marked by an update to the "Last updated" date. Continued use of the Services after changes take effect is considered acceptance of the updated terms.

The Services are intended for users at least 13 years old. Users who are minors in their jurisdiction must have the permission and supervision of a parent or guardian.

1. Our services

Information within the Services is not intended for distribution or use in any jurisdiction that prohibits such distribution or requires special registration. Access from other locations is done on your own initiative, and you are responsible for complying with local laws that apply.

2. Intellectual property rights

We are the owner or licensee of the intellectual property rights in the Services, including source code, databases, functionality, software, designs, audio, video, text, photos, and graphics (the "Content"), as well as trademarks, logos, and related marks (the "Marks").

The Content and Marks are protected by copyright, trademark, and related laws. The Content is provided "as is" for your personal, noncommercial use or internal business purposes only.

Subject to these terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and to download or print a copy of any Content you have lawfully accessed, solely for the purposes stated above.

Except as permitted here, no part of the Services, Content, or Marks may be copied, reproduced, distributed, sold, or exploited for commercial purposes without our prior written permission. Requests for permission can be sent to support@webekspres.id.

Violation of this section is a material breach and may terminate your right to use the Services.

3. Submissions and user contributions

If you send us questions, comments, suggestions, ideas, feedback, or other information about the Services ("Submissions"), you agree to assign the intellectual property rights in those Submissions to us. We may use and distribute Submissions for any lawful purpose without compensation to you.

If the Services provide a forum, blog, or similar contribution feature, material you post (“Contributions”) may be viewed by other users. By posting Contributions, you grant us a broad license (including the right to use, display, and distribute) as reasonably needed to operate the Services.

You are responsible for your Submissions and Contributions, you warrant that such material does not violate any law or third-party right, and you agree to indemnify us for any loss arising from such a violation. We may remove or edit any Contribution we consider harmful or in violation of these terms.

4. User representations

By using the Services, you represent that: (1) you have the legal capacity and agree to comply with these terms; (2) you are at least 13 years old; (3) if you are a minor in your jurisdiction, you have received parental or guardian permission; (4) you will not access the Services through unauthorized bots or automated means; (5) you will not use the Services for any illegal purpose; and (6) your use will not violate any applicable law.

If any information you provide is untrue, inaccurate, or incomplete, we reserve the right to suspend or terminate your access.

5. Purchases and payment

We may accept payment through the methods we present at the time of order (including cards supported by our payment partners). You agree to provide accurate purchase information and to update it as needed so transactions can be completed.

Prices are subject to change at any time. Payment is generally in Indonesian Rupiah (IDR) unless otherwise agreed. Taxes may be added as required by applicable regulations. We reserve the right to correct pricing errors, even after payment has been requested or received, and to refuse or limit orders we consider unreasonable.

6. Subscriptions

If you subscribe to a recurring service, the subscription may renew automatically until cancelled, based on the plan you selected. Cancellation can be requested by contacting us; it takes effect at the end of the period already paid for, unless otherwise agreed.

Changes to subscription fees will be communicated in line with applicable law. Questions about subscriptions can be sent to support@webekspres.id.

7. Prohibited activities

You may not use the Services for any purpose other than the one we provide them for. Without limitation, you agree not to:

• Systematically retrieve data to build a database without our written permission

• Deceive or mislead us or other users, including to obtain account credentials

• Circumvent security features or restrictions on use of the Content

• Disparage or harm us or the Services, in our reasonable judgment

• Misuse our support services or submit false reports

• Use the Services in violation of any law

• Upload viruses, malware, or material that disrupts the operation of the Services

• Engage in unauthorized scraping, bots, or automation

• Impersonate another user or person

• Reverse engineer any software making up the Services except as permitted by law

• Use the Services to compete with us or for an unauthorized commercial venture

8. Third-party sites and content

The Services may contain links to or content from third parties. We do not review the completeness, accuracy, or privacy practices of such third parties and are not responsible for them. Accessing third-party sites or content is at your own risk. This section no longer applies once you leave our Services.

9. Services management

We reserve the right, but have no obligation, to: monitor violations of these terms; take appropriate legal action; restrict or disable Contributions; remove files that overburden our systems; and otherwise manage the Services to protect our rights and smooth operations.

10. Privacy policy

By using the Services, you agree to the privacy practices we apply to the Services, which form part of these terms. The Services are hosted in Indonesia. If you access them from a region with different data rules, you consent to your data being transferred to and processed in Indonesia to the extent permitted by law.

11. Term and termination

These terms remain in effect while you use the Services. At our discretion and without notice or liability, we may deny access to the Services (including blocking specific IP addresses) for violating these terms or applicable law, or for any other reasonable cause.

If your account or access is terminated, you are prohibited from re-registering under a false name or the name of a third party. We also reserve the right to pursue appropriate legal remedies.

12. Modifications and interruptions

We reserve the right to change, suspend, or discontinue any part of the Services' content or availability at any time without notice. We do not guarantee the Services will always be available; interruptions may occur due to maintenance, technical issues, or other causes. We are not liable for any loss resulting from your inability to access the Services during such interruptions.

13. Governing law

These terms are governed by the laws of the Republic of Indonesia. You and WEBEKSPRES agree that the courts of Indonesia have jurisdiction to resolve any dispute arising from these terms.

14. Dispute resolution

You agree to submit disputes related to these terms to the jurisdiction of the courts of Indonesia. We also reserve the right to bring a claim in the country where you reside, or where your principal place of business is located if these terms are entered into in the course of business activity.

15. Corrections

Information on the Services may contain typographical errors, inaccuracies, or omissions, including regarding descriptions, pricing, or availability. We reserve the right to correct and update such information without prior notice.

16. Disclaimer

The Services are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Services, including fitness for a particular purpose and non-infringement. Your use of the Services is at your own risk.

We do not warrant the accuracy or completeness of the Services' content or any linked sites, and we are not liable for any loss arising from content errors, unauthorized access, transmission interruptions, third-party malware, or transactions with third-party providers.

17. Limitation of liability

To the fullest extent permitted by law, neither we nor our directors, employees, or agents will be liable for any indirect, consequential, incidental, special, or punitive damages, including loss of profit, revenue, or data, arising from your use of the Services.

Our aggregate liability to you, for any cause, is limited to the amount you paid us, if any, during the six (6) months before the claim arose, unless applicable law states otherwise.

18. Indemnification

You agree to defend and hold us harmless (including our affiliates and our officers, agents, partners, and employees) from third-party claims arising from: your Contributions; your use of the Services; your breach of these terms; your breach of any representation you made; your violation of a third party's rights; or any harmful act toward another user.

We reserve the right, at your expense, to assume the defense of any matter you are required to indemnify us for, and you agree to cooperate with that defense.

19. User data

We may store data you submit to manage the performance of the Services, along with data related to your use of them. Although we perform routine backups, you remain responsible for the data you submit. We are not liable for any loss or corruption of that data.

20. Electronic communications and transactions

Visiting the Services, sending an email, and filling out a form constitute electronic communications. You consent to receive electronic communications from us, and you agree that electronic notices satisfy any requirement for communications to be in writing where required by law.

You also consent to the use of electronic signatures, contracts, orders, and records, and to electronic delivery of notices and records for transactions initiated through the Services.

21. Miscellaneous

These terms, together with any related policies we post on the Services, constitute the entire agreement between you and us. Our failure to enforce any right does not waive that right.

If any provision is found to be invalid or unenforceable, that provision is severed and does not affect the remaining provisions. No joint venture, partnership, or agency relationship is created solely by these terms or your use of the Services.
